We have sold hundreds of homes for buyers from all parts of the United States and many other countries. In doing so, we have learned that contracting customs differ widely from area to area. We offer the following as a guide to the contracting customs and requirement in the Maryland and Virginia market.

Unlike many parts of the country, your real estate agent will have a lot of control over the contracting process until the sale is settled or closed. Once you have selected your home, we will write the contract using the standard board approved contract forms. These forms have been approved by the attorneys for the real estate commissions in Maryland and Virginia.

Contracts For Resale Homes

Only written contracts are enforceable. We will write the contract for you, explaining each paragraph thoroughly. The contract covers many procedures and contingencies, such as:

• Price
• Earnest money deposit
• Settlement date
• Financing description
• Seller's concessions, if any
• Property condition disclosure or disclaimer
• Lead based paint disclosure
• Home/Radon inspection contingency
• Settlement attorney
• Special location disclosures
• Homeowners Association disclosures, if any

That probably seems like a lot of documentation and compared to some other parts of the country, it is. But, in Maryland and Virginia, all terms and conditions are in writing and the document must be signed by the buyer and seller to be in effect. Your real estate agent will prepare and process all parts of the contract, including: financing, inspections, settlement, and any other duties that will help your purchase and move as satisfying as we can.

New Homes Contracts

If you decide to buy a newly constructed or to-be constructed home, the builder's representative will prepare the contract.
