DISCLOSURE REQUIREMENTS IN REAL ESTATE IN MARYLAND AND
VIRGINIA PERTAINING TO THE PRESENCE OF LEAD-BASED PAINT
Lead Based Paint - Information about homes constructed 1978 or earlier. Disclosure of the presence of lead-based paint is required in Maryland and Virginia or any property constructed in 1978 or earlier.
If you are considering buying a home constructed 1978 or earlier, you must consider the possibility that the home could contain paint that contains lead.
Studies have shown that the presence of certain levels of lead in the blood of
young children may lead to difficulties ranging from learning disabilities to
death of the child. Long term learning disabilities are present at a high rate
in children with high lead levels.
It is required that owners of properties offered for sale that were constructed during the time when paint containing lead disclose to the prospective buyer:
* That the property was constructed in 1978 or before.
* Known presence of lead-based paint or lead-based paint hazards.
* Any reports of previous test results for lead-based paint or lead-based paint hazards.
The buyer must be permitted to review this disclosure before making an offer on the property listed for sale.
The disclosure provides the buyer with an opportunity to have a lead-based paint inspection be done with a contingency that, if the presence of lead-based paint is discovered, the buyer can void the contract.
Or, the buyer can waive the opportunity to have a lead-based paint test done and continue with the purchase of the home.
