Real Estate Settlements in Maryland and Northern Virginia

If you've never been a home owner, the real estate settlement process can be intimidating. Not to worry. We'll be there with you and our real estate buyer's agents will prepare you for the settlement procedure so you will not be surprised by any document or procedure in Maryland or Virginia.

Once you have selected the home you wish to buy, have a contract to buy and the lender has qualified you for your loan, you are ready to "settle" the sale. That simply means, you pay the seller and the seller signs the deed. The title company or attorney then records a new deed in your name in the local county land records.

Real estate settlements in Maryland and Virginia are conducted by title attorneys or title companies working under the supervision of title attorneys. Their job is to make sure you get clear title to your home and that all of the documents are prepared correctly, and, most important, record your new deed in the land records of the county in which your home is located. Some of the services provided by the title attorney are:

Title Search and Title Examination
The attorney will order a search of the existing deed to identify any liens or encumbrances such as judgment liens or tax liens that may be recorded in addition to the deed of record and the existing mortgage.

When the attorney is satisfied that the title is free of any encumbrances, they will then issue title insurance to insure you and your mortgage company against any future claims against the ownership, transfer or equity in your home.

Survey
The attorney will obtain the services of a local surveyor to determine the boundary lines of the lot you are purchasing and any improvements (homes) located on the lot. You'll receive a certified survey at settlement. It will be helpful if you decide to construct any fencing.

Conduct the Settlement
The attorney will conduct the settlement at a location convenient to you and the sellers, usually the attorney's office. He/she will explain all the required documents to you so that you understand the process completely. Our real estate agents will be there to answer any technical questions anyone may have.

Record the Deed and Mortgage
Finally, you've selected your home, obtained a mortgage loan, paid the seller, and the final step is the recordation of your deed and mortgage, if you have one.
